User Agreement

This User Agreement for the service "Limex TV" (hereinafter referred to as the "Agreement") constitutes a public offer by LIMEXTR INTERNET TV VE DIJITAL PLATFORM HIZMETLERI LIMITED SIRKETI, registered at: Kısla mah. 37. Sk. Cengizhan Apt. No:6/102 Muratpasa/Antalya, 707060 Muratpasa/Antalya (hereinafter referred to as the "Owner"), addressed to any capable individual who has completed registration or accessed the service "Limex TV" (hereinafter referred to as the "Service") via the Internet (hereinafter referred to as the "User").

Registration of the User within the Service (creation of an Account), as well as the fact of using the Service, in cases where access to the Service is granted without registration under the terms of this Agreement, shall be considered a full and unconditional acceptance of the Agreement. Ignorance or lack of familiarity with the terms of this Agreement does not exempt the User from liability for failure to comply with its provisions.

If the User disagrees with any of the terms of this Agreement, he/she undertakes to refrain from using the Service in any form. The date of conclusion of this Agreement shall be the date on which the User accepts the Agreement.

1. Subject of the Agreement

1.1. The Service represents software owned by the Owner available to Users through installation on various electronic devices, including but not limited to: mobile phones, tablets, gaming consoles, media boxes, and televisions with SMART TV functionality (hereinafter referred to as "Devices").

1.2. Under this Agreement, the Owner provides Users with the ability to view licensed audiovisual works (hereinafter referred to as "Video Content") by granting remote access to Video Content via the Service over the Internet. The term "Video Content" may refer, depending on the context, to a specific audiovisual work, all or several audiovisual works, as well as a collection of audiovisual works forming the broadcast content of television channels and/or event transmissions available via the Service. The volume of Video Content available to Users from specific territories may vary and shall be determined at the discretion of the Owner, depending on restrictions imposed by the rights holders of such Video Content and mandatory requirements of the legislation of a particular country.

1.3. The Service allows Users to continuously watch free TV channels around the clock, and to obtain access to Paid Subscriptions under one-time or recurring payment conditions. These subscriptions include paid TV channels, Video Content from the Owner’s partners, and ad-free viewing for a certain period. An exception may be advertising displayed during the presentation of Video Content, which must be shown regardless of whether the User has purchased ad-free viewing. A complete list of Paid Subscriptions, along with their descriptions and pricing, is available inside the Service.

1.4. The Owner reserves the right to amend and/or supplement this Agreement at any time without notifying the User. The current version of the Agreement is available within the Service interface. Continued use of the Service after any changes and/or additions to the Agreement indicates the User's agreement with such changes and/or supplements. The User independently checks for updates and/or additions to the Agreement.

1.5. The User undertakes to regularly review the contents of this Agreement, no less than once every 14 days, in order to stay informed about any changes and/or additions made to it.

2. Rights and Obligations of the Owner

2.1. The Owner undertakes to ensure the technical possibility of providing Users with access to Video Content in accordance with this Agreement. At the same time, the Owner reserves the right to conduct scheduled maintenance or preventive works on equipment used for the operation and provision of access to the Service during off-peak hours.

2.2. The Owner reserves the right, at its sole discretion, to modify or remove any information, Video Content, and/or intellectual property results available on the Service, as well as to suspend, restrict, or terminate the User’s access to any section of the Service, Video Content, and/or other intellectual property results at any time, for any reason or without explanation, with prior notice or without notice. The Parties agree that the Owner shall not be liable for any damage that may be caused to the User as a result of such actions.

2.3. The Owner reserves the right to change the structure, design, and modes of operation of the Service, impose any limitations on the use of the Service, and unilaterally amend the Agreement at any time without obtaining the User’s consent.

2.4. The Owner reserves the right to send messages to Users, including via push notifications, containing organizational and technical information about the capabilities of the Service, as well as informational materials provided by the Owner.

2.5. The Owner reserves the right to impose age restrictions on Users' access to Video Content posted on the Service intended for a specific audience age group. This means that Users who have not reached the specified age are obligated to refrain from accessing and/or watching such Video Content, which the Owner may notify Users of by displaying signs indicating age ratings within the Service or through informational messages when Users attempt to view age-restricted Video Content.

2.6. The Owner reserves the right to block the User’s access to Video Content if the User violates the terms of this Agreement or if the Owner deems the User's actions to be fraudulent or aimed at destabilizing the operation of the Service, damaging the Service’s reputation or brand, organizing DDoS attacks, etc. Any funds paid by the User for the right to use the Video Content shall not be refundable in such cases.

2.7. The Owner reserves the right to involve third parties to fulfill obligations under this Agreement, including processing User requests through the Service’s support team, generating personalized offers for the User, and sending messages to the User.

2.8. Personal data processing by the Owner shall be carried out in accordance with the Privacy Policy, accessible within the Service interface.

2.9. The Owner reserves the right, and the User consents, to send the User promotional and organizational-technical messages.

2.10. The Owner has the right, and the User gives consent, to display advertisements placed within the Service and/or during the presentation of Video Content. If the User does not agree with this clause of the Agreement, he/she must immediately cease using the Service.

3. Rights and Obligations of the User

3.1. The User undertakes not to perform any actions aimed at destabilizing the operation of the Service, attempting unauthorized access to the Service, the intellectual property results and Video Content posted on it, or engaging in any other activities that violate the rights of the Owner and/or third parties.

3.2. The User shall not have the right to reproduce, duplicate, copy, sell, resell, or otherwise use the Service, Video Content, and/or intellectual property results posted on it in any way not provided for in the Agreement, without the written consent of the Owner and/or the copyright holders of the Video Content posted on the Service.

3.3. The User has the right to stop using the Service and delete his/her created Account by submitting a request to delete the Account to the Owner's support team from his/her email address to the Owner's email address.

3.4. The User undertakes to take appropriate measures to ensure the security of his/her Account and email address. The User bears full responsibility for any actions performed using his/her Account, as well as for any consequences resulting from such use. The User undertakes to immediately inform the Owner of any instances of third-party access to the Service using the User’s Account. The User shall not transfer, assign, sell, or provide access to his/her Account to third parties without the Owner’s consent.

3.5. The User, while using the Service, confirms that he/she is an adult and legally competent according to applicable legislation.

3.6. The User, having reached the age of majority, guarantees that minors’ access to Video Content is under his/her supervision, in compliance with restrictions established by applicable law.

3.7. The User, having reached the age of majority, under no circumstances will grant minors access to Video Content intended for adult Users, which is prohibited for viewing by minors according to applicable law. To avoid doubt, the User agrees that the Owner cannot verify the User’s age at the moment of access to the Service and therefore bears no responsibility to the User for the possibility of accessing such Video Content.

3.8. The User bears full responsibility for the compatibility of his/her Device with the Service and for the ability of his/her Device to view, download, and play Video Content. In the event that the User’s Device does not support the format of the Video Content, the Owner bears no obligation to compensate the User for the cost of the paid right to use the Video Content.

3.9. The User may use the Service only for personal non-commercial purposes. Use of the Service for public display of Video Content, even on a gratuitous basis, is prohibited.

4. Paid Subscriptions

4.1. The cost and conditions for providing Paid Subscriptions are indicated in the Service and may depend on the type of device used by the User, the user's location, and the quality of the Video Content provided.

4.2. By making a payment and using a Paid Subscription, the User confirms that he/she fully accepts these Terms for Paid Subscriptions.

4.3. To use a Paid Subscription, the User must register an account (Profile) in the Service or provide his/her email address without entering a password—depending on the method indicated in the Service. Registration of an account can be done by entering an email address and creating a password, or using authorization through third-party services, including social networks, in accordance with the Service’s functionality. To log in to the account, the User uses the previously entered email and password or logs in via the selected third-party service. When using a subscription without registration, the Paid Subscription is linked to the device on which the payment was made. In all cases, purchasing Paid Subscriptions for use by third parties is prohibited.

4.4. The Owner reserves the right to provide the User with a free trial period for using a Paid Subscription. The duration of the free trial period, the composition of available Video Content, and other conditions for its provision are determined unilaterally by the Owner.

4.5. Payment Procedure for Paid Subscriptions.

4.5.1. Payment for Paid Subscriptions is made through third-party payment systems. The Owner does not receive payments from Users. Relations between the payment systems and the User are governed by the agreements between the User and those entities. Questions related to the payment of Paid Subscriptions should be resolved by contacting the operators of the payment systems without involving the Owner.

4.5.2. Upon payment for Paid Subscriptions, the User agrees that the payment systems will deduct the subscription fee for the next billing cycle upon completion of the current paid period (automatic renewal).

4.5.3. The cost of Paid Subscriptions and the procedure for charging fees may be changed by the Owner at any time. Changes take effect at the beginning of the new billing cycle and do not apply to the current cycle being used by the User under the conditions in effect at the time of payment.

4.5.4. If the User continues to pay for services under the new prices after changes have been made, this will be considered automatic acceptance of the new conditions for the provision of the Service.

The Owner reserves the right to remove or add Video Content in the Service without prior notice or the User’s consent.

4.6. Refund.

4.6.1. Cancellation of purchases and refunds of paid amounts shall be carried out in accordance with the rules set by the corresponding payment system and this section of the Agreement.

The Owner processes refunds in accordance with return rules if the User did not timely cancel the Paid Subscription in accordance with Section 4.6 of the Agreement and submitted a request for cancellation of the subscription to the Owner on an individual basis.

Refunds are made proportionally to the unused portion of the subscription period as of the date the refund request is submitted.

4.6.2. To process a refund, the User sends the Owner a written application in free form containing information identifying the User, details of the completed payment, and the reason for the refund. The request can be sent via any available method, including email, feedback form in the Service, or other communication channels indicated by the Owner.

4.6.3. After receiving the request, the Owner verifies the payment information and, upon confirmation of the right to a refund, processes the refund within 10 (ten) business days from the date of receipt of the request.

4.7. Cancellation of Paid Subscription Without Refund.

4.7.1. The User may cancel a Paid Subscription at any time before the end of the current paid billing period.

4.7.2. Upon cancellation of a Paid Subscription, the User retains the right to use it until the end of the current paid period unless he/she has requested a refund in accordance with Section 4.6 of this Agreement. No charges will be collected for the next billing period if the User cancels the Paid Subscription.

5. Intellectual Property

5.1. All materials and intellectual property results used and posted in the Service, as well as the Service itself, are the intellectual property of the Owner, or the Owner is duly authorized to use the relevant intellectual property results by the respective rights holders. All rights to intellectual property results are protected by the applicable laws on intellectual property of the Republic of Turkey and relevant international legal conventions.

5.2. Any use of intellectual property results posted in the Service (including visual elements of the Service, symbols, texts, graphic images, illustrations, photos, videos, and other objects) without the permission of the Owner or the legitimate rights holder of the relevant intellectual property result is illegal and may serve as grounds for litigation and holding violators accountable in accordance with applicable law.

5.3. It is forbidden for any person to copy, reproduce, modify, rework, demonstrate, distribute, display in frames, publish, transmit, sell, or otherwise use intellectual property results posted in the Service, either in whole or in part, without prior permission from the Owner or the legitimate rights holder of the relevant intellectual property result, except in cases where the Owner or rights holder has explicitly expressed consent for free use of the intellectual property result by any person.

5.4. The Owner uses a system to protect Video Content from unauthorized use. The User undertakes not to attempt to circumvent the above protection system.

6. Limitation of the Owner's Liability

6.1. The Owner is not liable for technical failures or other problems related to any telephone networks or services, computer systems, servers or providers, computer or telephone equipment, software, or email or script malfunctions due to technical reasons.

6.2. The Owner is not liable for uninterrupted operation of the Service, cessation of the User’s access to the Service, or losses incurred by Users due to technical failures in the operation of the Service.

6.3. The User alone is responsible for the safety of his/her login and password for the account and for any losses that may occur due to loss or unauthorized use.

6.4. The Owner shall not be liable for any damage caused to the User and/or his/her property arising from the use of the Service.

6.5. The Owner shall not be liable to the User or third parties for any direct, indirect, or incidental damages, including lost profits, harm to honor, dignity, or business reputation, caused in connection with the use of the Service.

6.6. The Owner shall not be liable to the User or third parties for:

actions taken by the User in using the Service;

the content, legality, and accuracy of information used/received by the User while using the Service;

the accuracy of advertising information present in the Service and the quality of goods/services advertised;

6.7. The Owner shall not be liable to third parties for the User's violation of the terms of this Agreement.

6.8. In the case of claims made against the Owner by third parties related to the User's use of the Service, the User undertakes to resolve the disputes at his/her own expense and, if necessary, compensate for any damage caused.

6.9. The User is responsible for timely payment of all Paid Subscriptions and for providing valid credit card details or other payment methods within the Service.

6.10. The Owner does not guarantee high-quality video if the User's internet access tools do not meet minimum requirements (connection speed of at least 5 Mbps).

7. Final Provisions

7.1. Relations between the User and the Owner under this Agreement are governed by the laws of the Republic of Turkey. Disputes shall be resolved in the court located at the Owner’s place of business.

7.2. For complaints, questions, or suggestions regarding the operation of the Service, Users may contact the Owner at the following email address: [email protected]. When submitting a complaint, the User must provide documents confirming its validity and indicate his/her account details in the Service.
